And in some states you can’t get a marriage license if you’re shitfaced. In almost all states, you can’t sign a legal document of any kind while under the influence. But in those cases, the other person entering the deal/contract may not know the signer is under any influence.
Here, a cop is arresting someone SPECIFICALLY for intoxication, and then asking them to make an informed decision
